These Terms of Service ("Terms") govern your use of the ParPath mobile application ("App") operated by Ultraviolet Technologies, LLC ("ParPath," "we," "our," or "us"). By using the App, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.
You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the App with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using the App, you represent that you meet these requirements.
ParPath is a golf scoring and statistics tracking app. We provide:
You must sign in with Apple to use certain features. You are responsible for maintaining the security of your account and all activities that occur under it. You agree to notify us immediately of any unauthorized use of your account.
The App offers a free tier with limited functionality, including up to 3 rounds per month. We reserve the right to modify the features and limits of the free tier at any time.
ParPath Pro is available as an auto-renewing subscription at the following prices (subject to change):
All purchases are processed by Apple. To request a refund, visit reportaproblem.apple.com or contact Apple Support. We do not process refunds directly. Canceling your subscription will stop future charges but will not result in a refund for the current billing period. You will retain access to Pro features until the end of your current billing period.
You agree not to:
ParPath and its content, features, and functionality (including but not limited to design, text, graphics, logos, and software) are owned by ParPath and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.
You retain ownership of data you submit to the App (scores, statistics, profile information). By using the App, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to store, process, display, reproduce, and use this data to: (a) provide and maintain the App's features, (b) improve our products and services, (c) generate aggregated and anonymized statistics, and (d) create backups. This license continues until you delete your data or account.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PARPATH, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to indemnify, defend, and hold harmless ParPath and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the App, (b) your violation of these Terms, (c) your violation of any rights of another party, or (d) your User Content.
Any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the English language and shall take place in Los Angeles County, California, or at another mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND PARPATH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
You may opt out of the arbitration and class action waiver provisions by sending written notice to support@getparpath.com within 30 days of first accepting these Terms. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration.
We may suspend or terminate your account and access to the App at any time, with or without cause, with or without notice. You may delete your account at any time through the App's Profile settings. Upon termination:
The App uses Mapbox for maps and satellite imagery and may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via an in-app notification or email to your registered address before the changes take effect. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
ParPath reserves the right (but has no obligation) to investigate suspected violations of these Terms. We may, without limitation: (a) report any activity that we suspect violates any law or regulation to appropriate law enforcement officials, regulators, or other third parties, (b) disclose your account information, content, or other data in response to a subpoena, court order, or other legal process, and (c) take any action we deem necessary to protect the safety, rights, or property of ParPath, our users, or the public.
You agree not to export, re-export, or transfer the App or any technical data obtained through the App to any country, entity, or person prohibited by applicable export control laws, including but not limited to U.S. Department of Commerce regulations and U.S. Treasury Department sanctions. You represent that you are not located in, under the control of, or a national or resident of any restricted country or on any restricted parties list.
If you are a California resident under 18 years of age and a registered user of the App, you may request removal of content or information you have publicly posted. To make such a request, contact us at support@getparpath.com with a description of the content. Note that removal does not ensure complete erasure of the content from all systems (e.g., backups, cached copies, or content reposted by other users).
If you downloaded the App from the Apple App Store, the following additional terms apply:
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Subject to the arbitration provisions in Section 11, any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Los Angeles County, California.
You agree that any claim or cause of action arising out of or related to the App or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred. This limitation applies regardless of whether the claim is based on contract, tort, statute, or any other legal theory.
